1. About these terms
These Terms & Conditions govern use of the Orbix Online website and provide general terms for enquiries about our digital marketing, creative, advertising, content and website services. A signed quotation, proposal, statement of work, invoice, or other written service agreement may contain more specific commercial terms; where there is a conflict, the agreed service document will control to the extent permitted by law.
2. Website information
We try to keep the website accurate and current, but service descriptions, availability, pricing, package inclusions and timelines can change. A website price is not a final contract until accepted in writing by Orbix Online.
3. No guaranteed marketing outcome
Marketing performance depends on factors outside our control, including the offer, audience, budget, competition, platform policies, algorithms, approvals and market conditions. Unless expressly stated in a written agreement, Orbix Online does not guarantee a particular number of leads, sales, followers, rankings, revenue or advertising results.
4. Client responsibilities
Clients are responsible for providing accurate information, timely approvals, lawful content and necessary rights or permissions for logos, photographs, videos, testimonials, music, fonts, trademarks and other materials they provide. Clients are also responsible for ensuring that claims about their own products or services are accurate and legally permitted.
5. Third-party platforms
Services may involve Meta, Google, Instagram, WhatsApp, hosting providers, advertising platforms or other third parties. Their outages, policy changes, account restrictions, pricing, algorithms and decisions are outside Orbix Online's control.
6. Intellectual property
Unless otherwise agreed in writing, each party retains rights in materials it owned before an engagement. Rights in newly created work, source files, licensed assets and final deliverables are governed by the applicable quotation or agreement. Third-party trademarks and copyrighted materials remain the property of their respective owners.
7. Acceptable use
You must not use this website to submit unlawful, fraudulent, abusive, malicious or infringing material, or attempt to interfere with its security or operation.
8. Limitation
To the extent permitted by applicable law, Orbix Online is not responsible for indirect or consequential losses arising solely from use of this website or third-party platform outages. Nothing in these terms excludes a liability that cannot lawfully be excluded.
9. Governing law
These terms are governed by the laws applicable in India. Subject to mandatory consumer or other statutory rights, disputes will be addressed through the process agreed in the applicable service contract; if no such process exists, the parties may approach a court of competent jurisdiction in Karnataka.
